Florida police say a 10-year-old boy was killed when the scooter he was riding overturned and flew into oncoming traffic.

A 10-year-old boy has died after the scooter he was riding overturned, throwing him into oncoming traffic, Florida police said.

The man who was driving the scooter when it overturned accused of being drunk at that time and was arrested, according to a Nov. 11 news release from the Tampa Police Department.

A 37-year-old man, Yordanis Leyva, was driving a scooter with a boy sitting in front of him on Nov. 10 around 6:40 p.m. when he made a wide turn into a gas station, the release said. The scooter fell, as a result of which the man and the child were thrown into the oncoming traffic lane.

According to police, the driver of an oncoming vehicle “didn’t see them to stop” and hit them both.

Leyva and the child were taken to a local hospital, where the child died, police said. They did not say whether Leyva and the child are related.

Leyva was arrested on charges of driving under the influence, involuntary manslaughter and driving with a suspended license causing death, the release said. He is still in the hospital with serious injuries.

According to the police, the accident is under investigation.
