A 25-year-old driver was shot and killed during a traffic accident in Georgia, officials said.

A 3-year-old child in the car was found “with a minor cut from flying glass” after a shooting on Monday, Oct. 31, according to the DeKalb County Police Department.

Now, in the case, the man is accused of murder, according to the publications. Police did not list information about the attorney for the suspect, who they identified as 59-year-old Eric Simmons, in a news release.

The rescuers received a call around 1:00 p.m parking lot on Gresham Road, near Interstate 20 and less than 10 miles southeast of downtown Atlanta, according to police and WXIA. Officers found the man had been shot multiple times and was taken to the hospital.

The man later died. He has been identified as 25-year-old Darryl Wiley.

A 3-year-old girl found in the car was examined after the window was broken, police said.

The shooting was reported to be the result of an accident on I-20. Police said the suspect followed Wiley before getting out of the car and firing a gun several times.

“I heard shots, and I ran to the window to see what happened,” Jigneshkumar Patel, who works in the area, told WSB-TV. “I see the guy was lying on the floor.”

Simmons was later arrested and taken to the DeKalb County Jail. He was charged with murder and aggravated assault, according to news outlets.

Police did not elaborate on the traffic incident in a news release and did not immediately share additional information with McClatchy News on Nov. 4.
